Changes to NDIS Legislation – What You Need to Know
On August 22, 2024, the Australian Parliament passed the National Disability Insurance Scheme Amendment (Getting the NDIS Back on Track No. 1) Bill 2024. This significant milestone aims to strengthen the NDIS and improve the experience for participants. 1. Eligibility Assessment
New Participant Pathways: The NDIA will now separately assess disability requirements and early intervention requirements. This change supports the creation of new pathways tailored to different participant needs.
Clarified Disability Requirements: Updated guidelines make it clear when mainstream systems are responsible for providing support, ensuring only those who need NDIS supports access the scheme.
2. Support and Funding
Supports for Impairments: The NDIS will fund supports specifically related to the impairments for which participants qualify.
Plan Management: The NDIA can amend how plans are managed if there are concerns about the proper use of funds.
Flexible Budgets: Introduces total funding amounts, funding component amounts, and funding periods in plans, making it easier for participants to manage their budgets.
3. Information and Compliance
Impairment Notices: Participants will receive notices detailing the impairments for which they meet NDIS requirements.
Information Gathering: The NDIA can request specific information or assessments if considering revoking a participant’s status. Non-compliance within a reasonable timeframe can lead to revocation.
